Mental Health
Criminal cases with mental health aspects or defenses take extra time, attention and care. They are very important cases and can be mishandled if an attorney is not well-versed in the area. Ms. Cohen handles clients with any and all mental health diagnosis. Ms. Cohen is well versed in all areas of the criminal justice system dealing with mentally ill defendants. Clients that have not guilty by insanity (NGI) defenses, mental health diversion, mental health court, competency issues, baker act proceedings, etc. Ms. Cohen has experience and relationships with most of the court recognized mental health doctors, programs and service providers in South Florida. |
Major Crimes
These crimes are generally crimes against persons which includes murder, sexual battery, and aggravated assault. Most major crimes carry sever penalties, typically 30 years to mandatory life in prison. These cases can be very difficult and complex. Handling them takes experience and focus. |
Firearms & Weapons
The State of Florida criminalizes not only the use or possession of a weapon or firearm in many situations, but it also enhances penalties if a firearm or weapon is used during the commission of other crimes. The best-known enhancement is called 10-20-life. This statute sets a minimum mandatory prison sentence if a person uses a weapon during the commission of certain crimes such as robbery and kidnapping. If a weapon is possessed during the crime the minimum penalty is 10 years in prison, if the firearm is discharged the minimum is 20 years, if a person is shot the minimum increases to 25 years and finally if a person is killed the minimum is life in prison. |
Drug Crimes
Drug charges are some of the most common crimes prosecuted in Florida. Florida statutes impose severe penalties for those convicted of drug crimes, whether it involves trafficking, selling, possession, or more. Each different drug, including prescription drugs, and illegal drugs such as meth, heroin, cocaine, marijuana have different penalties. Any drug crime can severely mpact your life and future and has collateral consequences such as driver’s license suspension. Defendants need aggressive representation to protect their rights and future. |
Domestic Violence
Domestic violence criminal cases usually begin with the police being called due to some incident between family members. Domestic relationships or family members are specifically defined by statute in Florida. The Florida definition of Domestic violence is “any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member.” FL statute § 741.28. A family member is defined as a “spouses, former spouses, persons related by blood or marriage, persons who are presently residing together as if a family or who have resided together in the past as if a family, and persons who are parents of a child in common regardless of whether they have been married. With the exception of persons who have a child in common, the family or household members must be currently residing or have in the past resided together in the same single dwelling unit.” FL statute § 741.28. |
